Process

Driver’s license restoration appeals are handled by the Michigan Department of State – Office of Hearing and Administrative Oversight (“OHAO”). Through the years, we have found that the process of regaining driving privileges is not that complicated or complex; however, if you are not familiar with the process, or you think it is a good idea to take legal advice from family/friends who think they are “in the know,” please consider that there are many potential pitfalls to stumble upon during the appeal process. If eligible for an appeal, we will carefully lay out a detailed game plan for putting your written materials together. The written components of a successful appeal are not complicated – an accurate request for hearing (SOS-257/258), character letters, drug screen, substance use evaluation (and supporting diagnostic documentation), proof of support, and other supporting evidence. Although relatively straightforward, we witness time and time again that Petitioners underestimate or misinterpret the information that OHAO needs in the form of written materials. Often times, a Petitioner has already blown their appeal chances prior to even walking through the door to present evidence/testimony at a hearing. Again, like the written materials, the hearing itself is not that complicated; however, we often find that unrepresented petitioners completely miss the mark when presenting the necessary evidence to the hearing officer simply because they have no idea what should be presented.
